Definitions
- “Padel Club”, “we”, “us” or “our” means the owner and operator of the Padel Club which rents out padel courts.
- “You” or “your” means any user of our website or our services, including but not limited to members and guests.
- Services: renting padel courts and materials or services in our catering industry.
- Rented: the rented items such as padel courts and materials.
- User: the user of the application The Padel Point
1. General Information
1.1. Welcome to the website of The Padel Point. These terms and conditions apply to the use of our website and the services provided by our Padel club.
1.2 By accessing and using our website, you agree to be bound by these terms and conditions. If you do not accept these terms and conditions, you should not use our website.
1.3 We may modify these terms and conditions at any time without prior notice. By continuing to use our website, you accept any modifications to these terms and conditions.
2. Booking Padel Courts
2.1 You can book padel courts through The Padel Point booking tool or by contacting us directly.
2.2 All bookings are subject to availability, and we reserve the right to refuse any booking at our discretion.
2.3 Payment must be made at the time of booking. We accept payment by credit/debit card, or Mpesa.
2.4 If you need to cancel your booking, you must give us at least 24 hours’ notice. If you cancel within 24 hours of your booking, you may be charged a cancellation fee.
2.6. Bookings are not cancelled due to bad weather, or other external factors it is your responsibility to decide if factors will allow you to play.
2.7. We reserve the right to cancel your booking at any time without liability to you in the event of any unforeseen circumstances or situations beyond our control.
3. Use of Padel Courts
3.1 You must wear appropriate footwear and clothing while using the padel courts. (Studded shoes are strictly prohibited)
3.2 You must follow our rules and regulations regarding the use of the padel courts, including but not limited to:
a) No smoking or vaping within the club premises.
b) No pets allowed within the club premises.
c) No food or drink allowed on the court.
d) No use of the court while under the influence of alcohol or drugs.
3.3 You are responsible for any damage caused to the padel courts or equipment during your use.
3.4. You must vacate the padel court promptly at the end of your booking time.
4. Liability
4.1 We are not liable for any injury, loss, or damage to persons or property that may occur while using our padel courts or other club facilities.
4.2 You use our padel courts and other club facilities at your own risk.
4.3 We recommend that you obtain appropriate insurance coverage to protect yourself against any losses or damages.
5. Intellectual Property
5.1 The content of our website, including but not limited to text, graphics, logos, images, and software, is our property.
5.2 You may not copy, reproduce, distribute, or use any content from our website without our prior written consent.
6. Governing Law and Jurisdiction
6.1 These terms and conditions are governed by and construed in accordance with the laws of the Republic of Kenya.
6.2 Any disputes arising out of or in connection with these terms and conditions shall be subject to the exclusive jurisdiction of the courts of the Republic of Kenya.
